Participant Waiver and Assumption of Risk

1. Who this waiver covers
This waiver is between you and ThriverPlus (“ThriverPlus”). It applies to you if you take part in any physical activity, workout, game or competition whose results are recorded or displayed on ThriverPlus (an “Event”).
It does not cover the organiser. ThriverPlus is a software provider. Your event is run by a gym, box, club or other organiser, who is a separate business. Any waiver, release or medical declaration that the organiser asks you to sign is a separate agreement between you and them, and this waiver neither replaces nor limits it.
2. Assumption of risk
You acknowledge and agree that:
- participation in fitness competition — including lifting, gymnastics movements, running, rowing, cycling, high-intensity conditioning and timed workouts — carries an inherent risk of injury;
- those risks include, but are not limited to, muscle and tendon strains, sprains, fractures, dislocations, back and joint injury, cuts and bruising, heat illness, dehydration, rhabdomyolysis, cardiac events, permanent disability and death;
- risks can arise from your own actions, from the actions of other participants, from equipment, from the condition of the venue, and from the nature of competition itself, which encourages people to push beyond their normal limits;
- you take part voluntarily, with knowledge of those risks, and you accept them.
3. Fitness to participate
You confirm that:
- you are physically fit and have no medical condition, injury or impairment that makes it unsafe for you to take part;
- you have obtained medical advice if you had any doubt, and it is your responsibility — not ThriverPlus’s and not the organiser’s — to decide whether to compete;
- you will stop if you feel unwell or in pain, and will tell the organiser’s staff or medical personnel;
- you will follow the organiser’s rules, safety briefings and the instructions of its staff and judges.
4. Release of liability
To the fullest extent permitted by law, you release ThriverPlus and its officers, employees and contractors from all claims, demands and causes of action for injury, illness, death, loss or damage to property arising out of or in connection with your participation in an Event — whether the loss is caused by the risks described above, by the organiser, by another participant, or otherwise.
What this does not exclude. Nothing in this waiver excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by our own negligence, for fraud, or any liability that applicable consumer protection law does not allow us to exclude. If any part of this waiver is held unenforceable in your jurisdiction, the rest continues to apply.
5. Emergency medical treatment
If you are injured at an Event, you consent to the organiser or its medical personnel arranging emergency first aid or medical treatment. ThriverPlus does not provide medical cover, first aid or supervision at any Event, and is not present at Events.
6. Scores, results and disputes
Scores displayed on ThriverPlus are entered by the organiser’s staff and are provisional until the organiser finalises them. The organiser is the authority on official results, placings, standards and prizes. Take any dispute about a score, a judging decision or a placing to the organiser. ThriverPlus is not liable for scoring errors, omissions or delays, or for any consequence of them.
7. Publication of your name and results
Leaderboards on ThriverPlus are public. Your name, category or division, scores and ranking may be visible to anyone with the link, without an account, and may be indexed by search engines. Your contact email, if the organiser records one, is not published and is visible only to that organiser’s staff. Full detail is in our Privacy Policy.
If you would prefer your name shortened or removed, ask your event organiser — they control the entry — or contact us at privacy@thriverplus.com.
8. Participants under 18
A person under 18 may take part only where their parent or legal guardian has agreed to their participation and to this waiver on their behalf. If you enter a minor into an Event as an organiser, you confirm you hold that agreement — see section 8 of the Terms of Use. We recommend that organisers display junior athletes by first name and last initial.
9. If you are an organiser
Accepting this waiver when you create a ThriverPlus account covers your own participation. It does not cover the athletes you enter. You remain responsible for obtaining a participation waiver and any medical declaration directly from each athlete, or from their parent or guardian, before the Event.
10. General
This waiver is governed by the laws of Malaysia and should be read together with our Terms of Use and Privacy Policy. It applies to every Event you take part in while your account is open. We record the version you accepted and the date you accepted it.
